Tiens en cherchant des info sur l'évolution de l'affaire MPLAYER/KISS, je suis tombé sur l'interview radio entre les 2 parties.
2 choses m'ont marqué :
1) On retrouve dans la défense de Kiss un argumentaire déjà utilisé par d'autre : la légalité de la GPL
Peter: We have confirmed what we already knew, that when using code licensed under the GPL then we have to publish any derivative work. This means that the legal foundation is very thin and there is no place in the world that I know of where the GPL has been tested in court. So from a business perspective I would say that the license is relatively weak.

The conclusion will be that the licenses in this area are a good description of how one ought to operate within this community. They're more of a tool to describe how to operate than a set of rules that can be used in court. And I think that the Open Source circles uses far too much energy on hunting down private companies like us for instance, because it's so obvious that one as a private company simply can't release your source code.
2) Ca serait Mplayer qui aurait par on ne sait quel procédé récupérer du code de Kiss et qu'il aurait été intégré à Mplayer. C'est un comble quand le code "suposé volé" concerne le MPSUB (MPlayer SUBtitle), string qui apparait distinctement dans le firmware de Kiss ...

It can be hard to tell how those similarities have supposedly appeared.
Après, je ne pense pas que le fait que le terme "MPSub" apparaisse dans le firmware de Kiss prouve qu'il y ait un vol de code. Je me goure peut-etre totalement mais il me semble que Kiss est tout a fait dans dans son droit d'intégrer MPSub à son firmware, du moment que celui-ci (mpsub) n'ait pas été modifié.
Néanmoins, au vu des réactions de Kiss, je pense que cette histoire mérite d etre approfondie.
