Users must agree to all provisions of these Terms of Service (hereinafter referred to as "these Terms") in order to use Radio Use Online Application and Geographic Information for the Radio Propagation Blockage Prevented Area (collectively referred to as "the Service"). By using the Service, each User is deemed to have agreed to these Terms.
Purpose
Article 1.
These Terms are provided by the Ministry of Internal Affairs and Communications (hereinafter referred to as the "Service Provider") to define the obligations and responsibilities between the Service Provider and any person who uses the Service (hereinafter referred to as the "User"), and to obtain the User’s consent to the items necessary for using the Service.
Definitions
Article 2.
For the purposes of these Terms, the following terms have the meanings set forth below:
(i)"User" means a person who uses any of the services provided by the Service, including those who are provisionally registered.
(ii)"Account ID" means a user identification code issued by the Service based on an email address authentication process, used to identify a specific User.
(iii)"Open ID" means a user identification code assigned by an external authentication service, compliant with OpenID Connect, which can be used to access the Service.
(iv)"Account" means either an Account ID or an Open ID.
(v)"Smartphone application" means the smartphone application used by a User for two-factor authentication.
Scope of the Service
Article 3.
The Service provides functions for issuing, managing, and authenticating Accounts, as well as related or ancillary functions, with regard to the following services:
(i) Radio Use Online Application
(ii) Geographic Information for the Radio Propagation Blockage Prevented Area
Principle of Self-Responsibility
Article 4.
Each User shall use the Service at the User’s own responsibility and under the User’s own control, and is fully responsible for all actions taken and all outcomes arising from the use of the Service.
2. If a User causes damage or disadvantage to a third party or the Service Provider in relation to the use of the Service, that User shall resolve such damage or disadvantage at the User’s own expense and responsibility.
Procedures for Issuance of Accounts
Article 5.
A person wishing to use an Account must register for both a provisional account and a full account by providing and submitting accurate, current, and truthful information as specified by the Service Provider.
2.The Service Provider may refuse an application for registration if any part of the submitted information is false, erroneous, or incomplete, or if the Service Provider deems the registration otherwise inappropriate. The Service Provider is not required to disclose the reason for any such refusal.
3. A person applying for provisional registration shall not use another person’s email address or a temporary or disposable email address for registration.
4. Upon completing the requirements of Paragraph (1) above, a User may register an Account by one of the following methods:
(i) Login using Mynaportal
(ii) Login using gBizID
(iii) Login using an digital certificate
(iv) Login using login ID and password
5. In connection with Paragraph (1) or Paragraph (4) above, the User agrees that all information related to the registration of the User’s Account will be transmitted to and stored on a server managed by the Service Provider.
6. The User shall promptly update any information if it changes after registration.
7. If a User submits false information, causing the Service Provider to rely on it, the Service Provider may suspend that User’s Account and prohibit the User from using the Service in the future.
Registration of Information for Notification, etc.
Article 6.
When an Account is issued, the User shall provide the User’s email address and telephone number to the Service and shall be deemed to consent to receiving notifications (including by SMS) at those contact points.
2. A User who uses an Open ID shall be deemed to have created an Account in accordance with the rules of the relevant external authentication service, and to consent that the ID linkage information is stored on servers managed by the Service Provider for use of the Service.
3. Except when using an Open ID, a User of the Smartphone application shall be deemed to have registered an Account and consented that device-identifying information is stored on both the User’s device and on servers managed by the Service Provider, and that notifications may be sent to the User’s device.
Restrictions on Issuance of Accounts
Article 7.
Users shall limit the number of Accounts they hold to the minimum necessary and shall not register an excessive number of Accounts without justifiable reason.
2. If a User registers multiple Accounts and the Service Provider deems the necessity of such Accounts questionable, the Service Provider may restrict the User’s ability to use any or all of those Accounts. The Service Provider shall bear no liability for any damage or disadvantage suffered by the User as a result of this restriction.
Handling of Account Registration Information
Article 8.
If the User does not complete full registration of an Account within a specified period after provisional registration, the Service Provider may delete the provisional registration without prior notice.
2.If the Service Provider determines that a User’s Account has remained unused for a significant period, the Service Provider may delete that Account’s registration information.
Account Management Obligations
Article 9.
Each User shall be responsible for managing the User’s Account ID and password and, in the case of two-factor authentication, for managing any relevant device information (hereinafter collectively referred to as "Passwords, etc."). Users must manage their Passwords, etc. under their own responsibility and shall not disclose or share them with any unauthorized party.
2. Users shall bear sole responsibility for any loss, misuse, theft, or other compromise of their Account IDs or Passwords, etc. The Service Provider shall not be liable for any resulting damage or disadvantage.
Prohibited Acts
Article 10.
Users shall not engage in, or attempt to engage in, any of the following acts, nor any act that might be deemed to fall under the following:
(i) Any act that interferes with the operation of the Service or undermines the credibility of the Service Provider
(ii) Any act that unfairly disadvantages other Users of the Service or the services covered by the Service
(iii) Any act that violates these Terms, violates any applicable law or regulation, or offends public order and morals
(iv) Unauthorized or improper access to the Service
(v) Impersonation of another person
(vi) Discrimination against or slander of others, or any act that defames the reputation or credibility of others
(vii) Using a single Account among multiple individuals
(viii) Any other act that interferes with the operation of the Service or causes damage or disadvantage to a third party
Suspension or Deletion of Accounts by the Service Provider
Article 11.
If any of the following circumstances apply, the Service Provider may, at its sole discretion, suspend the Account(s) involved without prior notice:
(i) The User has violated any provision of these Terms
(ii)The Service Provider has determined that the Account has been, or is at risk of being, used fraudulently
(iii) The Service Provider has verified that the registration information is incorrect or has been changed without proper procedure
(iv) The Service Provider deems it necessary due to a change in Account-related standards or in the content of the Service
(v) In addition to the above, the Service Provider deems it necessary to maintain the smooth operation of the Service, including but not limited to the potential for interference with its operation
2. The Service Provider may also suspend or delete an Account if it determines that the Account is inactive, for instance where it has not been used for a certain period.
3. The Service Provider shall not be liable for any damage or disadvantage suffered by a User whose Account is suspended or deleted pursuant to the preceding paragraphs.
Suspension or Deletion of Accounts by the User
Article 12.
The User shall immediately suspend or delete the User’s Account in the following cases:
(i) When there is a possibility of loss, leakage, theft, forgery, fraud, embezzlement, or other unauthorized use of the Account
(ii) When the User intends to discontinue use of the Account
(iii) When the User otherwise recognizes a need to suspend or delete the Account
2. If the User fails or delays in taking action as set forth in the preceding paragraph, the Service Provider shall not be liable for any damage or disadvantage suffered by the User as a result of such failure or delay.
3. In a case falling under Paragraph (1), if a third party suffers damage or disadvantage as a result of the User’s failure or delay in taking prescribed action, the User shall resolve any dispute with that third party at the User’s own expense and responsibility, and the Service Provider shall assume no liability whatsoever.
Account Deletion
Article 13.
A User may terminate the User’s relationship with the Service at any time by deleting the User’s Account.
2. Once the User deletes the Account, all data associated with that Account shall be deleted, and the Account can no longer be used to access the Service.
3. The Service Provider shall not be liable for any damage or disadvantage suffered by a User as a result of deleting an Account under the preceding paragraph.
4. If a third party suffers damage or disadvantage as a result of the User’s deletion of the Account, the User shall resolve any dispute with that third party at the User’s own expense and responsibility, and the Service Provider shall bear no responsibility.
5. Even if the Account cannot be deleted due to loss of authentication information or for reasons attributable to the User, the Service Provider shall not be obligated to delete the Account on the User’s behalf.
6. Under no circumstances shall the Service Provider provide a way to restore a deleted Account.
Intellectual Property Rights
Article 14.
All moral rights, copyrights, know-how, and other intellectual property rights contained in the programs and other works (including these Terms, user manuals, etc.) provided to Users by the Service Provider belong solely to the Service Provider, and do not belong to Users.
2. When using the Service, the User shall handle all such programs and other copyrighted works in accordance with the following provisions:
(i) Use them only for the purpose of using the Service in accordance with these Terms
(ii) Do not reproduce, modify, edit, distribute, or perform reverse engineering on them
(iii) Do not lend or transfer them, nor create any security interest over them, for the benefit of any third party, whether or not for profit
(iv) Do not remove or modify any copyright or trademark notices displayed by the Service Provider or any entity designated by the Service Provider
Handling of Personal Identifiable Information
Article 15.
The Service Provider shall handle any personal identifiable information obtained from Users through the use of the Service in accordance with the "Privacy Policy" separately stipulated.
2. The Service Provider may disclose such personally identifiable information, to the extent necessary, in any of the following cases:
(i) When responding to a request in accordance with Article 23-2 of the Attorneys Act
(ii) When responding to an inquiry made under Paragraph (2) of Article 197 of the Code of Criminal Procedure
(iii) When disclosure is required by a court of law, the police, or another authority under applicable laws or regulations
Acquisition and Handling of Information on Use of the Service
Article 16.
By using the Service, Users are deemed to consent to the Service Provider’s collection of cookies and other usage data for the following purposes:
(i) Provision, verification, and improvement of the Service’s functions
(ii) Improvement of the Service’s quality
(iii) Analysis and dissemination of information relating to usage of the Service and its contents
Disclaimers
Article 17.
The Service Provider shall not be liable for any damage or disadvantage suffered by a User or a third party as a result of the use or inability to use the Service.
2. The Service Provider assumes no liability in any of the following circumstances:
(i) When the User fails to promptly update registration information after an actual change occurs
(ii) When the User’s Passwords, etc. are leaked or otherwise disclosed to a third party
(iii) When a defect, failure, or other problem arises in any software, hardware, network, etc. used by the User, or when the User commits an operational error
(iv) When damage or disadvantage occurs due to a natural disaster such as an earthquake, eruption, tsunami, or typhoon
(v) When damage or disadvantage occurs due to a fire, power outage, or suspension of public services
(vi) When damage arises due to enactment or amendment of relevant laws and regulations, or as a result of a court or administrative disposition
(vii) When hardware or other equipment managed by the Service Provider fails for reasons beyond the Service Provider’s control
(viii) In other cases, including when the User violates these Terms, or when damage occurs for reasons not attributable to the Service Provider, or for reasons of force majeure
Temporary Suspension of the Service
Article 18.
The Service Provider may temporarily suspend all or part of the Service, after giving prior notice to Users, if it deems it necessary for routine maintenance or other valid reasons.
2. The Service Provider may, by posting a notice on the Service’s website, suspend or discontinue the Service entirely under any of the following circumstances; provided, however, that in emergency situations, the Service Provider may do so without advance notice:
(i) When maintenance inspections of the Service’s systems or equipment are scheduled
(ii) When the Service suffers a major disruption due to a natural disaster, incident, or other situation
(iii) When the Service Provider deems it otherwise necessary to suspend or discontinue the Service
Notification to Users
Article 19.
The Service Provider shall notify Users by email, posting on the Service’s website, or any other method deemed appropriate by the Service Provider. Even if a notification sent to the User’s registered email address is delayed or not delivered, it shall be considered received at the time when it would ordinarily have reached the User.
Revisions to These Terms
Article 20.
The Service Provider may revise these Terms at any time when it deems such revision necessary, without prior notice to Users.
2. Any such revised Terms shall become effective and binding on the User either when the Service Provider publishes the revision in a manner it prescribes or when the Service Provider separately notifies the User, whichever occurs first. Even if the revision is made after a User has already obtained an Account, the User shall be deemed to have agreed to the revised Terms.
Requests for Information Regarding Use of the Service
Article 21.
The Service Provider may request that Users provide information regarding their use of the Service, such as by conducting surveys or similar methods. Users shall make reasonable efforts to respond to such requests to the extent possible.
Usage Fee
Article 21-2.
The use of this service is free of charge. However, users are responsible for preparing all necessary equipment (including software and communication means) at their own expense. Additionally, any communication costs required to use this service, costs for obtaining or renewing electronic certificates, and any other costs associated with the use of this service shall be borne by the user.
Attribution of Rights
Article 22.
If the Service Provider does not exercise any right provided under these Terms, this shall not be construed as a waiver of that right; all such rights remain vested in the Service Provider.
Governing Law and Jurisdiction
Article 23.
These Terms shall be governed by and interpreted in accordance with the laws of Japan.
2. The Tokyo District Court shall be the exclusive court of first instance with jurisdiction over any disputes arising between the Service Provider and the User in connection with the Service.
Supplementary Provisions
These Terms shall come into effect on January 6, 2025.
