Terms of Service for Radio Use Online Application

The Ministry of Internal Affairs and Communications (hereinafter referred to as "MIC") has set forth the following Terms of Service (hereinafter referred to as "Terms") to be followed when using Radio Use Online Application, as defined in Article 2.
You must agree to all of these Terms in order to apply for, view and receive license records, electronic disposal notifications, and electronic notifications related to radio use through Radio Use Online Application (this "Service" below). Users of this Service are deemed to have agreed to these Terms.

Purpose

Article 1.
The purpose of these Terms of Use is to set forth the matters that users of the service are required to agree to in connection with the use of the service operated by MIC.

Definitions

Article 2.
The below Terms shall be defined as follows.

(i) "Radio Use Online Application" refers to the government information service that processes applications, notifications, and other procedures related to the licensing of radio stations for radio use (including electronic payment of fees required for such procedures), as well as the viewing and receiving of license records, electronic disposal notifications, and electronic notifications via the internet.

(ii) "User" refers to a person who uses the Service to perform procedures, such as applications, notifications, and electronic payment of fees required when performing such procedures.

(iii) "Account ID" refers to a user identification code assigned to a User by the Service in order to identify the User.

(iv) "Open ID" refers to a user identification code assigned by an authentication service other than the Service and compliant with OpenID Connect.

(v) "Account" refers to an account ID or open ID.

(vi) "Inquiry number" refers to the number that is used by the Service to identify the user of an application, notification, or other procedure that a user has completed using the Service.

(vii) "Electronic application number" refers to the number that is used by the Service to identify the application, notification, or other procedure that a user has completed using the Service.

(viii) "Payment number" refers to the number assigned to a User by the Service to identify the purpose of payment when using electronic payment of fees, etc.

(ix) "Confirmation Number" refers to the number assigned to a User by the Service for the purpose of ensuring information security when identifying the user in the use of electronic payment of fees, etc.

(x) "Viewing PIN" refers to the number designated by the user when conducting application and notification procedures for equipment utilizing high-frequency current via the e-Gov Electronic Application Service, in order to view the permit for equipment utilizing high-frequency current through this service.

(xi) "license record, etc." refers to electronic or magnetic records that document matters related to licenses (referring to a radio station license record under Article 14-2 of the Radio Act, a registration record under Article 27-23, and a permit record created under the provisions of Article 14, paragraph (1), as applied mutatis mutandis pursuant to Article 100, paragraph 5). Users can view these records through the use of this service.

(xii) "Electronic Notification of Dispositions, etc." refers to electronic notification of dispositions as stipulated in Article 2, paragraph (1), item (xiv)-9 of the Regulation for Enforcement of the Radio Act.

(xiii) "Electronic Delivery" refers to the electronic issuance of notification documents, etc., by the Ministry to users of the Ministry of Internal Affairs and Communications Radio Use Electronic Application, without the premise of conducting application and notification procedures.

(xiv) "Electronic Notifications, etc." refers to notifications that are electronically delivered.

User Responsibilities

Article 3.
Users shall use the Service according to their own responsibility and judgment, and shall not hold any government administrative agency with jurisdiction over the following information arising from the use of the Service liable for any of the following items.

(i) Account

(ii) Inquiry number

(iii) Notification number

(iv) Electronic application number

(v) Payment number

(vi) Confirmation number

(vii) Viewing PIN

(viii) Other electronic information created or obtained and managed by the User

2. The User shall register an account according to the Terms separately laid out in the "Terms of Service for Account Services", and shall properly manage the account held by the User.

3. The User shall abide by the terms and conditions regarding the use of the Service posted on the Service's website.

4. The User shall prepare at their own expense all equipment (including those related to software and means of communication) necessary to use the Service. Furthermore, communication costs required to use the Service, costs to obtain or renew digital certificates, and any other costs associated with the use of the Service shall be borne by the User.

5. The User shall, from time to time, check the status of the processing of applications, notifications, and other procedures, as appropriate, using the status confirmation screen (My Page, etc.). MIC shall not be liable for any damage or loss incurred by the User, or to a third party by the User, through use of the Service.

6. Users agree to view or receive license records, electronic notification of dispositions, and electronic notification through the use of this service, and that these are considered to have been delivered to the user at the time they become available for viewing or receipt. Users also agree to check these as appropriate and from time to time using the status confirmation screen (My Page, etc.). The Ministry may not be held responsible for any damage or disadvantage to the user, or any damage or disadvantage caused by the user to a third party, due to the user's failure to check these.

7. Users agree that they will no longer be able to view license records once they lose their validity, and that electronic notification of dispositions and electronic notifications will no longer be viewable after a certain period has elapsed since the notification. Users shall download these as necessary.

8. Users agree that the email address registered at the time of requesting the issuance of an account for this system is considered to have consented to receiving emails from this system to that email address at the time of registration.

9. Users shall register an email address that can receive emails. The Ministry is deemed to have fulfilled its obligation by sending notifications to the registered email address, and the Ministry consider the notification to have been delivered at the time it would normally be expected to arrive, even if the delivery is delayed or fails to reach the user.

10. Users agree to check electronic notifications and emails sent to the email address registered at the time of requesting the issuance of an account for this system as appropriate and from time to time. The Ministry may not be held responsible for any damage or disadvantage to the user, or any damage or disadvantage caused by the user to a third party, due to the user's failure to check these.

11. Users agree that the Ministry may suspend the use of this service if it determines that there has been no actual use of the service for a considerable period.

Article 3-2.
Users agree to receive disposal notifications, etc., for applications and notifications made through this service by viewing electronic notification of dispositions through the use of this service. However, if the user notifies the Ministry that they wish to receive disposal notifications, etc., in writing, this provision does not apply, and disposal notifications, etc., will be issued in writing.

Delegation of Procedures for Applications, Notifications, etc.

Article 4.
When a User delegates to a third party performance of procedures, such as applications and notifications, to be performed through the Service, that User shall be deemed to have been delegated all authority necessary to perform the relevant aforementioned procedures.

2. The scope of delegation in the preceding paragraph shall include that the User who performs procedures such as applications and notifications under the delegation can view, receive, download, and print the license records, electronic disposition notifications, and electronic notifications related to the delegated procedures, from the day after the date of the relevant license or permit until at least one month has passed.

3. When a User who performs procedures such as applications and notifications changes or terminates the nature of delegation of authority to a third party, said User shall promptly notify MIC as necessary.

Electronic Payment of Fees and Other Charges

Article 5.
Users who wish to make electronic payment of fees and other charges shall do so in accordance with the following items.

(i) The User shall make electronic payment of fees in accordance with all relevant laws and by using the collection agency number, payment number, and confirmation number (collectively "Payment Numbers" below) provider by the Service to the User.

(ii) When paying fees electronically, there may be limits placed on the allowable method of electronic payment, the financial institutions handling payment, the period during which payment can be made, the issuance of receipts, and the amount allowable for payment.

(iii) Electronic payment may not be available due to unavoidable suspension of the Service due to planned or natural disasters or other reasons, restrictions on the use of Payment Numbers (electronic payments may be temporarily restricted to protect against unauthorized use by a third party), or other reasons including loss of transmission signal.

2. With respect to the electronic payment of fees, the User shall bear the fees required for the disbursement of deposits and savings as determined by the relevant financial institution and any other fees required for procedures, etc. with the financial institution.

Copyrights and Intellectual Property Rights

Article 6.
All copyrights and moral rights relating to programs or other copyrighted works (including these Terms and the application form instructions posted on the Service’s website, same below), as well as the intellectual property rights such as the know-how related to such copyrights and moral rights, shall be the sole property of MIC unless otherwise specified.

2. When using the Service, the User shall handle any and all programs or other works provided to the User by the Service in accordance with the following items.

(i) Use of any programs or other works shall be used only for the purpose of using the Service in accordance with these Terms.

(ii) No reproduction, modification, editing, distribution, or other reverse engineering shall be allowed.

(iii) The User agrees not to lend, assign, or grant security to a third party, whether for profit or not.

(iv) The User agrees not to delete or change the copyright notice or trademark notice displayed by MIC.

Hours of Use and Suspension of Use

Article 7.
In principle, this Service is available 24 hours a day, 365 days a year for applications and notifications. The Service may be stopped, suspended, or interrupted by MIC when necessary for maintenance or related reasons without prior notification to Users.

2. MIC may restrict the use of the Service to Users when the use of the Service becomes extremely concentrated.

3. If there is no access from the User to the service for a certain period of time, the session will automatically time out. Once the session timeout occurs, you will not be able to continue (the same applies if you close your browser). In this case, please close all browsers and then re-launch your browser.

4. MIC may, by posting on the Service website in advance, stop, suspend or discontinue use of the Service if any of the following is deemed to apply. However, in emergency situations, the Service Provider may stop, suspend, or discontinue use of the Service without any prior warning.

(i) When maintenance inspections of the equipment and other components of this Service are scheduled.

(ii) In the event of a serious disruption of this Service due to a natural disaster, incident, etc.

(iii) In any other cases where MIC deems it necessary to suspend or discontinue the use of the Service.

Prohibited Items and Restrictions on Use

Article 8.
When using this Service, Users shall not engage in any of the following acts.

(i) Use of the Service for any purpose other than the procedures required for applications and notifications to MIC, and viewing and receiving license records, electronic notification of dispositions, and electronic notification.

(ii) Unauthorized or improper access to the Service.

(iii) Intentional interference with the management and operation of the Service.

(iv) Intentionally sending a file infected with a virus to the Service.

(v) Making a false application or notification

(vi) Committing acts that violate or may violate laws, regulations, or public order and morals

(vii) Altering, editing, or otherwise modifying any program loaned or provided by the MIC to the User through the Service without the express permission of MIC

(viii) Engaging in any other conduct that interferes with or may interfere with the operation of the Service.

2. MIC may suspend or restrict use of the Service without prior notice to the User in the event that the User has committed or is deemed likely to commit any of the acts listed in the preceding paragraphs.

Characters Available for Use

Article 9.
The characters that can be used with this Service are those listed below.

(i) Alphanumeric characters and symbols standardized as JIS X 0201 as well as 1-byte characters

(ii) JIS 1 Kanji, JIS 2 Kanji

2. For characters not included in the range listed in the above paragraph (including cases falling under the preceding paragraph, same below), the User may select a similar character that does fall under the provided range based on their own judgment.

Data Formats Able to be Sent and Received

Article 10.
Except in the case of using Radio Use Online Application, the data format for sending and receiving data related to procedures such as applications and notifications to and from the Service shall conform to the data specifications for the Online Application API published by MIC, and shall also conform to the items published in the Radio Use Online Application.

Operating Environment Requirements

Article 11.
This Service is not available in environments where cookies and JavaScript are disabled. The operating environment requirements under which the User shall use the Service shall be in accordance with the requirements posted on the Service's website.

2. Please do not use the "back" or "forward" buttons on your browser when using this Service. Using the "back" and "forward" buttons on your browser may result in incorrect operation. Please use the buttons displayed on the page to operate the System.

Handling of Personal Identifiable Information

Article 12.
The System shall strictly manage Users' personal identifiable information and take measures to prevent loss, alteration, destruction, and leakage of such information. A firewall will be installed to prevent unauthorized persons from accessing the personal identifiable information of Users, and TLS (Transport Layer Security) encryption or other security technology compliant with TLS will be used to protect against unauthorized access by third parties when sending and receiving application information, etc., to ensure security.

2. MIC may disclose personal identifiable information obtained by MIC through the provision of the Service to the extent necessary in any of the following cases.

(i) When an inquiry request is made in accordance with Article 23-2 of the Attorneys Act

(ii) When an inquiry is made pursuant to paragraph (2) of Article 197 of the Code of Criminal Procedure

(iii) In other cases where disclosure is requested by a court of law, the police, or other authorities in accordance with laws and ordinances.

Acquisition and Handling of Information Pertaining to Use of this Service

Article 13.
This Service collects information on Users (users' Internet domain names, IP addresses, browser types, and operating system of device used) and usage status (access locations, URLs, and application information history) to the extent necessary for the smooth operation of this service. Collected information is used as a reference for analyzing User usage trends and for other purposes in order to improve the convenience of the services provided.

2. This System uses cookies to improve convenience. Cookies serve to identify Users (the User's browser) by sending information such as the session ID from the web server to the User's browser. The Cookie used is valid only during the session. Cookies sent from the System's server are deleted from the System's server as soon as the user logs out or the session times out. The information contained within these Cookies are the session ID of the user and the System ID, and session IDs alone cannot be used to identify individual users.

Disclaimer of Warranty and Disclaimer of Liability

Article 14.
The Service is provided to users on an "AS IS" basis, and MIC does not warrant that the Service is free from programming errors or other defects, that the Service is fit for a particular purpose, that the Service or its use does not infringe on the rights of users or third parties, or any other warranty of any kind. In addition, MIC shall not be liable for repairs or maintenance of this Service or any other such liabilities. MIC shall not be liable for any damage or disadvantage or loss incurred by the User, or to a third party by the User, through use of the Service.

2. Both the ID and password for this Service are proof of identity and must be strictly controlled. The User of the Service shall bear the responsibility for the management of both the ID and password, as well as any associated responsibilities, and the MIC shall not be liable for any loss or damage arising therefrom.

3. MIC shall not be liable for any damages or disadvantages incurred by the User or any third party due to the use or inability to use the Service.

4. MIC shall not be liable in any of the following cases

(i) When the User fails to promptly update their information in accordance with a change in the information registered with the Service, despite such change having actually occurred.

(ii) When the User's account information is leaked or otherwise misused by a person other than the User due to the User's willful misconduct or negligence.

(iii) When a defect, failure, or other problem occurs in the software, hardware, network, etc. used by the User, or when the User makes a mistake in operating the software, hardware, network, etc.

(iv) When damages or disadvantages occur due to a natural disaster such as an earthquake, eruption, tsunami, typhoon, etc.

(v) In the event of damage or disadvantage caused by fire, power outage, suspension of public services, etc.

(vi) Due to reasons arising from the enactment or amendment of relevant laws and regulations or disposition by a court or administrative agency.

(vii) In the event of failure of hardware or other equipment managed by the Ministry due to reasons beyond the control of MIC.

(viii) In addition to those listed in the preceding items, in the event that the User has violated these Terms, for reasons not attributable to MIC, or for reasons beyond the control of MIC.

Amendments to this Agreement

Article 15.
MIC, when it deems it necessary, may revise these Terms at any time without prior notice to Users.

2. The Terms of Service, revised in accordance with the preceding paragraph, shall take effect and apply to the User either when MIC announces the revised Terms of Service as part of Radio Use Online Application in the prescribed manner, or when MIC notifies the User of the revision, whichever is earlier.

3. When a User uses the Service after the revision of these Terms of Service, the User is deemed to have agreed to the revised Terms of Service.

Requests for Information Regarding Use of this Service

Article 16.
MIC may ask Users to provide information on their use of the Service by conducting questionnaires or by other means. In such cases, Users shall make efforts to respond to requests for information to the extent possible.

Usage Fee

The use of this service is free of charge. However, this excludes the case specified in Article 3, paragraph 4.

Attribution of Rights

Article 17.
The rights of MIC as set forth in these Terms shall be thereby assumed by MIC even in the event MIC fails to exercise such rights and shall not be deemed to have been waived.

Governing Law and Jurisdiction

Article 18.
The Terms and Conditions shall be governed by the laws of Japan.

2. The Tokyo District Court shall be the exclusive court of first instance for all lawsuits arising between MIC and the User in connection with the use of the Service.

Supplementary Provisions

These Terms shall be effective from January 6, 2025.
