Parce qu'en reconnaissant officielement l'applicabilité de brevets de MS et en faisant ce genre de deal les protégeants eux et leurs clients sans proteger toute autre personne qui redistriburait ou patcherait un soft sous GPL contenu dans une SuSE, alors Novell vient de s'auto interdire de publier les softs en question dont il reconnait que des brevets de MS s'appliquent, et les developpeurs concernés peuvent exiger le retrait de leur programme sous GPL de la SuSE à cause de cette insécurité juridique (dans certains pays).

Autre rappel : la GPL impose qu'il soit légal de pouvoir vendre un binaire (à condition de respecter tout le reste en particulier de livrer les sources sur demande), de vendre des sources.
Donc si Novell se met à distribuer des softs sous GPL en ayant des accords avec MS qui de fait "interdisent" aux personnes recevant le soft de la part de SuSE d'en faire commerce, alors ils feraient mieux de s'attendre à se faire attaquer et à devoir retirer des softs de leur distro.
