Legal Capacity of Persons with Disabilities in Asia (2018_2_40_022)
Outline
This study will aim to clarify the legal capacity of persons with disabilities in Asia and identify the issues hindering legal capacity using the Convention of the Rights of Persons with Disabilities (CRPD) as criteria. Equality before the law is one of the basic human rights and is indispensable in order to exercise other human rights. However, historically, the legal capacity of persons with disabilities has often been denied. Therefore, CRPD requests State Parties to shift their paradigm and provide the necessary assistance to enable disabled persons to exercise their legal capacity. This study will not only examine the status of each country, but will also try to identify the common issues in Asia using comparative analysis.
