Welcome to Creatly! These Terms and Conditions ("Terms") apply to your use of creatly.me and related services (the "Platform"), operated by AIKAY TECHNOLOGIES PRIVATE LIMITED (Creatly, "we", "us", or "our").
By using the Platform, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, please do not use the Platform.
1. About Creatly
Creatly is a platform that helps creators sell digital products, services, subscriptions, and memberships to their audience. We operate as an "Intermediary" under the Information Technology Act, 2000 — we provide the technology, but we do not create or own the products that Creators sell.
2. Who can use Creatly
You can use Creatly if you are:
- At least 18 years old, and
- Legally allowed to enter into a contract under Indian law.
If you are signing up on behalf of a company, you confirm that you have the authority to do so.
3. Your account
When you sign up, you must provide accurate information. You are responsible for keeping your password safe and for everything that happens in your account. If you notice any unauthorized access, let us know right away.
We may ask you to verify your identity (KYC) at any time. If you don't complete verification, we may suspend or close your account.
4. Plans and payments
Creatly offers Free, Pro, Pro+, and Ultimate plans. Pricing and features are listed on our pricing page.
- Subscriptions are billed monthly or annually through Razorpay.
- Auto-renewal: Paid plans renew automatically. You'll get a notification at least 24 hours before each charge, as required by RBI rules.
- Cancellation: You can cancel anytime from your account. You'll keep access until the end of your billing cycle. Subscription fees paid are non-refundable except where required by law.
- Taxes: All fees are exclusive of GST (currently 18%). We will issue tax invoices.
5. What creators can sell
Creators can sell digital products, services, courses, subscriptions, and memberships through Creatly. Creators are fully responsible for:
- The accuracy of their listings, prices, and delivery
- Customer support for their products
- Their own taxes (income tax, GST) on the sales they make
What's not allowed
You cannot use Creatly to sell or share:
- Adult or sexually explicit content
- Anything illegal in India (drugs, weapons, counterfeit goods, etc.)
- Content that infringes someone else's copyright or trademark
- MLM, pyramid, or chain-marketing schemes
- Misleading offers or fake guarantees
- Hateful, abusive, defamatory, or harassing content
- Gambling or betting services without proper licenses
- Cryptocurrency or financial securities without regulatory approval
- Malware or anything harmful to users
- Anything else prohibited under Indian law
If you violate these rules, we may remove your listings, suspend your account, or report you to law enforcement.
6. Payouts to creators
Creator payouts are processed through Cashfree Easy Split using vendor accounts, in line with RBI rules.
To receive payouts, you must:
- Complete KYC (PAN, bank account, etc.)
- Have a valid Indian bank account in your or your business's name
Settlement: Payouts happen on the schedule shown in your dashboard, after we deduct:
- Our platform fee (0-6% based on your plan)
- Payment gateway fees
- GST (18%) on our commission
If a payment is reversed (chargeback or refund), the amount will be deducted from your future payouts.
7. Refunds
- Subscription fees paid to Creatly are non-refundable.
- Refunds for products sold by Creators depend on the Creator's refund policy and these minimum rules:
- If the Creator does not deliver the product, you'll get a full refund.
- If the product is materially different from what was described, you can request a refund within 7 days.
- If a Creator cancels a session, you'll get a full refund.
Approved refunds are processed in 7-10 business days to your original payment method.

8. Content ownership
- Your content stays yours. Creators own the content and products they upload.
- License to us: By uploading content, you give us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it on the Platform — only as needed to run Creatly. This license ends when you delete your content.
- Buyers get a personal-use license for what they purchase, unless the Creator allows broader use.
- Creatly's brand and software belong to us. You can't copy or reuse them without permission.
If you believe content on Creatly infringes your copyright, email support@creatly.me and we will act on valid notices within 36 hours, as required under Indian law.
9. Suspension and termination
We may suspend or close your account if:
- You break these Terms
- You break the law
- You engage in fraud or abuse
- We're required to do so by a court or government authority
- Your account is inactive for more than 12 months
You can close your account anytime from your settings or by emailing us. Pending payouts will be settled after we deduct any fees, refunds, or chargebacks.
10. Disclaimer
Creatly is provided "as is." We don't guarantee that the Platform will always work without bugs, downtime, or errors. We don't warrant the quality of products sold by Creators — that's between the Creator and the Buyer.
11. Limitation of liability
To the extent allowed by law, Creatly is not liable for any indirect, incidental, or consequential damages (like loss of profits, data, or business). Our total liability to you for any claim will not exceed the amount you paid us in the 12 months before the claim, or ₹10,000, whichever is less.
12. Use of your name
By using Creatly, you allow us to use your name, logo, profile picture, and storefront link in our marketing — for example, on our website, social media, or pitch decks — to show that you use Creatly. If you'd rather not, email us at support@creatly.me.
13. Changes to these terms
We may update these Terms from time to time. We'll post changes on this page and update the "Last updated" date. If the changes are major, we'll notify you by email. Continued use after changes means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of India. Any disputes will be handled by the courts in Delhi, India.
