The devil is in the details on the common European patent
A controversial patent directive on software has won official adoption by the EU council of ministers working on competition affairs.
The matter must now go back to the European Parliament for a second reading.
Spain was the only member state to oppose the common position backing the patent, and Belgium, Italy and Austria abstained in the vote on the decision.
Six countries lodged formal requests for further clarifications.
Parliament feels the directive will damage small and medium-sized businesses.
The project pits big companies who want to be able to patent as much as possible against less powerful players who argue in favour of leaving new ideas broadly accessible.
