Le probleme et que, selon mon interpretation je l'avoue toute personnelle, je pense que des drivers proprio dans le kernel posent bel et bien des problèmes de license. Cela constitue (un noyeau enrichi d'un nouveau driver) à mon humble avis un travaille dérivé, et donc la modification devrait être sous GPL.
Ce n'est pas l'avis de tout le monde (linus ?) mais c'est défendable.
Une exeption à la GPL au niveau du copyright du kernel :
" NOTE! This copyright does *not* cover user programs that use kernel
services by normal system calls - this is merely considered normal use
of the kernel, and does *not* fall under the heading of "derived work".
Also note that the GPL below is copyrighted by the Free Software
Foundation, but the instance of code that it refers to (the Linux
kernel) is copyrighted by me and others who actually wrote it.
