Transition of Disability Laws in China: Prospect of Domestic Implementation of CRPD

Outline

The purpose of this study is to discover how China's disability laws have changed in various areas to realize the rights of persons with disabilities. In particular, the 2006 UN Convention on the Rights of Persons with Disabilities, in which China has been actively involved in its drafting, have influenced domestic legislation of various countries. China, as a member state, is required to comply and implement the CRPD in its domestic laws. However, although China belongs to the continental legal system centering in codified law, it has developed a socialist legal system, which has influenced the implementation of the Convention. This study will clarify how China's disability laws transformed after the adoption of the 1990 Act on Protection of Disabled People through the ratification of the Convention on the Rights of Persons with Disabilities, and its dialogue with the Committee on the Rights of Persons with Disabilities.
