Allan Reiver, who operated the neighboring Elizabeth Street Gallery, began developing the once vacant and city-owned site as a garden in 1991. Councilwoman Margaret Chin first marked the garden for development in 2012,[1] the start of a lengthy dispute over the garden. The New York City Department of Housing Preservation and Development has managed proposals for development of the site.[2] Following a legal battle, the New York Court of Appeals ruled to allow development in 2024. However, the city government canceled these plans in June 2025, and Mayor Eric Adams designated the site as a city park that November. His successor, Zohran Mamdani, indicated during his campaign that he would restart the development.
