There appears to be a typo in this page. I believe that in the phrase "at the same time defining it in tems of the proof which had previously been usual", "tems" should be "terms". (For that matter, "which" should be "that": "at the same time defining it in terms of the proof that had previously been usual."

I am not a legal expert and therefore did not attempt to edit it.
