Opinion Calling to Further Promote International Arbitration/Mediation in Japan

The Japan Federation of Bar Associations (the "JFBA") compiled its "Opinion Calling to Further Promote International Arbitration/Mediation in Japan" dated January 23, 2025, and submitted it on January 24, 2025 to the Minister of Justice; the Minister of Foreign Affairs; the Minister of Economy, Trade and Industry; the Minister of Land, Infrastructure, Transport and Tourism; the Commissioner of the Japan Patent Office; and the Commissioner of the Japan Sports Agency.


Summary of Opinion


The JFBA, in terms of lawyers who serve as a party’s representative or adviser, who use the system of arbitration or mediation, or as arbitrators or mediators presiding over the process, while recognizing the significance of international arbitration and mediation as a public service and the importance of implementing these processes in Japan, in order to further promote international arbitration and mediation, urges the government and stakeholders, including other organizations related to international arbitration and mediation, to resolve the following various problems, and cooperate with each other, and we will continue to do our best to realize these.


1. Promoting arbitration and mediation at the same time;

2. Capacity building for arbitration and mediation;

3. Maintaining the international standard in conducting arbitration and mediation;

4. Developing the infrastructure, including facilities for hearing in arbitrations and mediations;

5. Further internationalization in operations of organizations to implement the procedures;

6. Further promotion of educational activities for users of arbitration and mediation; and

7. Financial public support to resolve each problem.
