New Complaints

The OSPF received four complaints on the Peshawar Sustainable Bus Rapid Transit Corridor Project. Two of the four complaints were deemed ineligible for the problem-solving process because complainants have yet to address issues with the concerned ADB Operations Department, while the other two were withdrawn and complainants are indirectly affected by the project. COMPLAINTS

The Office of the Special Project Facilitator (OSPF) registered 17 complaints in 2021. All of these were deemed ineligible for the problem-solving process due to lack of good-faith efforts by the complainants to resolve their issues with the concerned ADB operations departments.

The ADB Accountability Mechanism is a last-resort mechanism, and the concerned ADB operations department is required to try to address the issues raised in the complaint before it is elevated to the ADB Accountability Mechanism.

Punjab Intermediate Cities Improvement Investment Project

Two complainants, representing 33 families, raised issues about the project on (i) land acquisition, valuation, and compensation; (ii) lack of meaningful consultation and participation; (iii) inadequate information dissemination; and (iv) livelihood restoration (photo by ADB).

PAKISTAN

Two complainants (brothers) alleged that the lease agreement for 50 acres of the estate was fraudulently entered into by an unauthorized representative of the 30 estate shareholders. INDIA

Uttar Pradesh Major District Roads Improvement Project

Two complainants alleged (i) possibility of road accidents due to lack of traffic safety signages and other measures and (ii) lack of compensation (photo by complainants).

NEPAL

Tanahu Hydropower Project

The complainants from the Dalit and Magar indigenous peoples communities, supported by a local nongovernment organization, alleged that the project will cause direct and indirect material harm; and that information sharing, consultation, and participation were inadequate leading to unfair compensation. This is the third complaint on this project. The first complaint, received in 2018, was also deemed ineligible, while the second complaint, received in 2020, was deemed eligible for the problem-solving process (photo by OSPF).

Greater Mekong Subregion Tourism Infrastructure for Inclusive Growth

The complainants were the owner and the manager of an elephant camp. They alleged that soon after the ADB-assisted project had rehabilitated the roads in 2020, the banana plantation started operations along the roads, without the requisite approval from the relevant provincial authorities. The plantation was alleged to have been causing environmental damages and an elephant was allegedly killed by the operators of the plantation (photo by complainants).

Tamil Nadu Urban Flagship Investment Program (Tranche 2)

The complainants raised (i) that the sewage treatment plant component of the project was close to the Palar River and to the residential areas with 25,000 families, and (ii) that the project was not in accordance with national laws and other guidelines (photo by ADB).

The two complainants raised issues related to (i) adverse impacts on the existing road caused by the project’s rebuilding and upgrading works, (ii) encroachment of the project on part of the existing road due to soil from the new embankment under the project, (iii) access and safety, and (iv) inadequate consultations. Khyber Pakhtunkhwa Cities Improvement Project

The two complainants want the transfer of the solid waste management facility to another location at Salhad, Abbotabad. They alleged that the project would harm ecotourism, affect the quality of their water, and thus also affect irrigation and crop production (photo by ADB).

Jalalpur Irrigation Project

The complainants raised issues in connection with the location of the project. They explained that it would affect their residential area and may cause damage and flooding. Thus, complainants wanted the irrigation canals to be re-routed. This is the third complaint on this project.
