The JFTC Issued Cease and Desist Orders to Tokyo Bay Licensed Pilots’ Association and Ise-Mikawa Wan Licensed Pilots’ Association

The Japan Fair Trade Commission (JFTC) today issued the cease and desist orders to Tokyo Bay Licensed Pilots’ Association and Ise-Mikawa Wan Licensed Pilots’ Association, finding that they unjustly restricted the functions or activities of the members in violation of Article 8 (iv) of the Antimonopoly Act by:
(1) Restraining the members from making a contract with the users in their own discretion;
(2) Pooling the pilotage fees of the members and distributing them to the members on a per capita basis.
Prior to the issuance of the cease and desist orders, the JFTC had notified the associations of the contents of the proposed orders and provided them with opportunities to submit their opinions and evidences to the JFTC. The orders have been issued after the JFTC took into consideration the opinions and the evidences so submitted. A recipient dissatisfied with the order may request, within sixty days of the service of the transcript of the order, the JFTC to initiate the hearing procedures regarding the order.
