Abstract of Project Proposal
アジア諸国における土地の収奪や強制労働、違法・不当な逮捕などの権利侵害は、人々の安全で豊かな暮らし を脅かしている。これらは「法」により防ぐことのできる問題であるが、人々は「法」や弁護士を活用できず、権利を 守ることができていない。そこで、法的サービスのアウトリーチ及び人々と弁護士のインターフェースの向上・改 善を図るプロジェクトを実施し、人々が権利を守るために「法」や弁護士を活用する機会の増大を目指す。 ベトナム、カンボジア、ラオスは、集権的構造や家父長制など社会背景を同じくしており、同調圧力に屈しない権 利意識の涵養や、弁護士に対する社会の認知度の向上など、共通のチャレンジに直面している。日本もこうした 課題に長年取り組んできた。本プロジェクトは、悩みを共有する者どうしが学びあいを通じて共通課題の解決を 図る取組みであり、外部の知見や「受け手」の意見を積極的に取り込むという新たな枠組みで実施される。
In Asian countries, there are serious violations of human rights such as land grabbing, forced labor and unjust and/or illegal arrest, and these threaten people’s well-being. Although those violations may be prevented by proper application of laws, most of the people are excluded from legal protections because they do not have easy access to laws and lawyers. This project is aiming to improve legal outreach activities and to provide user-friendly interfaces between ordinary people and lawyers. This project will increase people’s access to legal services so as to protect their own rights. Vietnam, Cambodia and Laos share similar features such as centralized governing structures and paternalistic societies. In terms of the enhancement of access to justice in these three countries, there are common challenges of increasing awareness of human rights, which is all too often lost under peer pressure, and raising social awareness of lawyers’ role. Japan has the same challenges to enhance access to justice. In this project, parties who all have common challenges cooperate in dealing with those through learning from each other. The project is carried out drawing on external expertise and receiving feedback from users of legal services.
実施したプロジェクト内容と方法
Describe the implemented project and the method used
新型コロナウイルス感染症の拡大によりプロジェクト活動は主にオンライン形式で実施された。オンラインによるパートナーとの継続的な意見交換・情報共有に加え、日本及びパートナー各国の4か国によるオンラインセミナー及び日本とパートナー各国との間における2か国間活動(ワークショップなど)を実施し、「正義へのアクセス」の改善に関する知見・経験を共有するとともに相互の理解を深めた。
プロジェクトの開始段階では、すべてのプロジェクト活動を対面で行うことを計画しており、2020年初頭からパートナー国における活動を実施しようとしたまさにそのタイミングでパンデミックが発生した。これを受けて、2020年半ばからプロジェクト活動に関するパートナーとの協議をオンラインで継続的に実施し、対面でのプロジェクト活動の再開を目指して、プロジェクト期間の延長も視野に入れて、ぎりぎりまでコロナ禍の一定の収束を待つこととした。しかし、2021年も半ばを過ぎてなおパンデミック収束の見通しが立たなかったため、パートナーとの合意の下、オンラインでの協議を中心としてプロジェクト活動を実施することとなった。
そこで、オンラインによる継続的協議を踏まえ、2021年11月に、日本及びパートナー国の4か国でオンラインセミナーを実施し、本プロジェクトの目標を再確認するとともに、日本及びパートナー各国の2国間におけるオンラインを中心とした活動を行い、その成果を4か国で共有することを確認した。
これを受けて、日本とカンボジアの2国間においては、「司法アクセス強化のための課題、活動そして学び」をテーマにオンラインワークショップを実施した。また、カンボジアの首都と地方都市所在の大学(Royal University of Law and Economic:カンボジア王立法律経済大学及びNational University of Battambang:国立バッタンバン大学)において、現地の大学生を対象に「司法アクセス強化プロジェクト:弁護士の役割と責任に関する普及」のテーマでセミナーを行うことで、法曹人材の育成及び継続的な司法アクセスの向上に貢献する企画を実施した。
日本とベトナムの2か国間においては、「ベトナム・日本における法普及・法教育」をテーマにオンラインワークショップを実施した。また、「遠隔地における司法アクセスの改善」をテーマに、ベトナムの山間部及び日本の島しょ部における司法アクセスの改善について、それぞれ具体的な取組みを交えた紹介及び議論を行うオンラインワークショップを実施した。
日本とラオスの2か国間においては、法律扶助制度の概要及び地方における弁護士会の取組みをテーマとしてオンラインワークショップを実施した。また、「リーガルエイドの過去・現在・未来」をテーマにオンラインワークショップを実施した。
上記のパートナー各国と日本の2か国間の活動を経た後、2022年7月、日本とパートナー各国から代表者が参加して、それぞれの成果を発表し、共有するとともに、将来の展望等を確認するセミナーを実施した。 さらに、同セミナーの実施後、ラオスにおいて、本プロジェクトの成果を司法関係者と広く共有することを目的として、法律扶助の活動内容並びに法律扶助における裁判所、検察官、警察官及び弁護士の4機関の役割等について、司法省、裁判所、検察院及び警察機関の関係者を招いたセミナーを実施し、意見交換を行った。このセミナーには、パンデミックの状況の改善を受け、日本のメンバーも対面で参加した。
加えて、日本弁護士連合会が独立行政法人国際協力機構からの委託を受けて実施した研修で使用した司法アクセスに関する教材をパートナー各国の現地語に翻訳して共有し、本プロジェクトの終了後もパートナー各国における司法アクセスの改善のための活動に活用してもらうこととした。
以上のとおり、本プロジェクトは、新型コロナウイルス感染症の影響を受け、当初の計画とは異なるアプローチでの活動を余儀なくされたが、オンラインによる継続的な意見交換やウェブ会議システムを活用したセミナー・ワークショップを行う等の工夫により、学び合いを深める活動を行った。
Due to the spread of the COVID-19 infection, project activities were conducted primarily in an online format. In addition to continuous online exchange of views and information between Japan and partners, the online seminars were held in four countries(Japan and each partner country), and bilateral activities (workshops, etc.) were conducted between Japan and each partner country to share knowledge and experiences on improving "Access to Justice" and to deepen mutual understanding.
At the beginning of the project, all project activities were planned to be conducted face-to-face, and the outbreak of the pandemic occurred at the very time when activities in each partner country were to be implemented starting in early 2020. Then, we decided to wait until the last minute for a certain degree of containment of the COVID-19 disaster, with a view to extending the project period, with the aim of resuming face-to-face project activities through ongoing online discussions with partners starting in mid-2020. However, as the pandemic was still not expected to be resolved by the middle of 2021, we agreed with the partners that the project activities would be conducted mainly through online consultations.
Therefore, based on the continuous online discussions, the online seminar was held in November 2021 in four countries(Japan and each partner country). In the online seminar, the four countries reaffirmed the goals of this project and confirmed to conduct activities mainly online between Japan and each partner country and to share the results of the online seminar among the four countries.
In response, an online workshop was held between Japan and Cambodia on the theme of "Challenges, Activities, and Learning for Enhancing Access to Justice". In addition, the project was designed to contribute to the development of legal human resources and the continuous improvement of access to justice by conducting seminars on the theme of "Enhancing Access to Justice Project: Dissemination on the Role and Responsibilities of Lawyers" for local university students in Royal University of Law and Economic and National University of Battambang.
An online workshop was held between Japan and Vietnam on the theme of "Dissemination of Law and Legal Education" in Vietnam and Japan. In addition, under the theme of "Improving Access to Justice in Remote Areas", an online workshop was held to introduce respectively and discuss specific efforts to improve access to justice in mountainous areas of Vietnam and in island areas of Japan.
In Japan and Lao PDR, an online workshop was held on the theme of "the overview of the legal aid system and the efforts of bar associations in rural areas". In addition, an online workshop was held on the theme of "Legal Aid: Past, Present, and Future.
After the above-mentioned bilateral activities between Japan and each partner country, an online seminar was held in July 2022 with the participation of representatives from Japan and partner countries to present and share their respective achievements and to confirm future prospects.
After the seminar, a seminar was held in Lao PDR in order to share the results of this project with people in the judiciary, inviting officials from the Ministry of Justice, courts, prosecutors' offices, and police agencies to explain the activities of legal aid and the roles of the four institutions in legal aid: courts, prosecutors, police officers, and lawyers. Due to the improved pandemic situation, Japanese members also participated in this seminar on face-to-face.
In addition, educational materials on access to justice that were used in the training conducted by the Japan Federation of Bar Associations (JFBA) on behalf of the Japan International Cooperation Agency (JICA) were translated into the local languages of the partner countries and shared, so that they could be used in activities to improve access to justice in the partner countries after the completion of this project.
As described above, this project was affected by the COVID-19 infection and had to take a different approach from the original plan. However, activities to deepen mutual learning were carried out through continuous exchange of opinions online, seminars and workshops using web conference systems and other innovations.

本プロジェクトは、日本とそのパートナー国であるベトナム、ラオス、カンボジアの4か国が「正義へのアクセス」に関する学び合いを実現することを目的として実施されたものである。
4か国が参加するオンラインセミナーでは、「正義へのアクセス」に関する4か国の現状の法制度、取組み、課題等を全体で共有することができた。具体的には、各国に共通する課題として、過疎地域の人々に対する司法アクセスが不十分であること、司法支援を十分に行う人材、資金等のリソースが不足していること等の問題があることが確認された。
日本とパートナー各国との間で実施された2か国間のワークショップでは、パートナー各国が関心を持っている事項について、日本とパートナー各国の具体的な制度や取組みについてより詳細にわたる学び合いを実現することができた。具体例を挙げると、過疎地域の現場で活動しているベトナムの弁護士と、貧困層に対する司法支援に携わっている日本の弁護士がスピーカーとして参加したセッションでは、現場のリアルな話を共有することで、両国にとって有意義な学び合いを実現することができた。
また、2か国間での活動として、カンボジアで大学生向けに、ラオスで司法関係者向けに、それぞれ多数の参加者を招いたセミナーが開催された。こうしたセミナーでは、プロジェクトメンバーがプロジェクトの成果を参加者と共有し、参加者からフィードバックを受けた。こうした取組みにより、プロジェクトメンバーは、発信を通じて本プロジェクトの学び合いの内容をより深く理解するとともに、「正義へのアクセス」を更に改善するための様々な視点や知見に触れ、各国における今後の方針を検討する視座を獲得した。
こうした2か国間のプロジェクト活動の成果は、4か国オンラインセミナーで共有され、将来の展望等についても4か国全体で確認することできた。
さらに、司法アクセスに関する教材を現地語に翻訳した資料をパートナー各国に共有したことで、パートナー国のメンバー及び司法関係者が「正義へのアクセス」に関する新たな学びを得る素材を獲得した。
(2)今後期待される波及効果
本プロジェクトを通じて、日本及びパートナー各国における「正義へのアクセス」に関する課題や取組みについて学び合い、情報共有することができたため、今後は、本プロジェクトで学びあったことを活かしてそれぞれの国における「正義へのアクセス」を実現する活動を実践していく取組が展開されることが期待される。この際、本プロジェクトにおいて共有された司法アクセスに関する教材が活用されることが期待される。
また、上記(1)に記載したように、ラオス及びカンボジアでは、司法アクセスに関する業務に携わっている又はこれから携わる可能性のあるセミナー参加者を対象とする本プロジェクトの成果の共有・普及が既に行われている。ベトナムのプロジェクトメンバーを含め、パートナー国のメンバーは同様の取組の継続・発展に意欲を示している。
加えて、カンボジアのプロジェクトメンバーは、2023年1月又は2月に、プノンペンにおいて、本プロジェクトのメンバーに加え、シンガポールやフィリピンの司法関係者にも声をかけて、司法アクセス改善に向けた拡大セミナーを開催することを計画している。本プロジェクトにより、ベトナム、ラオス、カンボジアのパートナー各国が互いに交流を行う機会を持つことができ、国境を越えた学び合いの意義を見出したことがこのような計画につながっている。今後、日本とパートナー各国との間及びパートナー各国との間のみならず、更に広域での交流も含めた国際交流が展開され、アジア地域全体で正義へのアクセスの改善の取組が広がることが大いに期待される。
(1) Outcomes at the end of the grant period
This project was implemented with the aim of realizing a learning exchange on "Access to Justice" among four countries,Japan and its partner countries; Vietnam, Lao PDR and Cambodia.
The online seminar, in which the four countries participated, made it possible to share the current legal systems, initiatives, issues, etc. in the four countries as a whole. Specifically, the four countries confirmed that they have common issues, such as insufficient access to justice for people in underpopulated areas and lack of resources, such as human and financial resources, to adequately provide justice support.
The bilateral workshops conducted between Japan and partner countries enabled a more in-depth exchange of information on specific systems and approaches in Japan and partner countries on issues of interest to each partner country. To cite a specific example, a session in which a Vietnamese lawyer working in a depopulated area and a Japanese lawyer involved in providing judicial assistance to the poor participated as speakers was a fruitful learning experience for both countries, as they shared real stories from the field.
In addition, as activities between the two countries, seminars were held for university students in Cambodia and for judicial officials in Laos, each with a large number of participants. At these seminars, project members shared project results with participants and received feedback from them. Through these efforts, project members gained a deeper understanding of the project's learning content through dissemination, were exposed to various perspectives and knowledge to further improve "Access to Justice", and gained perspective to consider future policies in their respective countries.
The results of the project activities between the two countries were shared in a four-country online seminar, and future prospects were also confirmed in the four countries as a whole.
In addition, materials on access to justice were translated into local languages and shared with partner countries, which provided new learning materials on "Access to Justice" for members and judicial officials in the partner countries.
(2) Expected Ripple Effects
Through this project, we were able to learn from each other and share information on issues and efforts related to "Access to Justice" in Japan and partner countries, and we will continue to implement activities to realize "Access to Justice" in each country by utilizing what we learned from this project. It is expected that the participants will develop their own initiatives to implement activities to realize "Access to justice" in their respective countries based on what they learned from this project. In doing so, it is expected that the educational materials on access to justice shared in this project will be utilized.
In addition, as mentioned in (1) above, in Lao PDR and Cambodia, sharing and dissemination of the results of this project have already been conducted for seminar participants who are or may be involved in access to justice-related work. Members of partner countries, including project members in Vietnam, have expressed willingness to continue and develop similar efforts.
In addition, the Cambodian project members plan to hold an expanded seminar on improving access to justice in Phnom Penh in January or February 2023, inviting not only members of this project but also judicial officials from Singapore and the Philippines. This project has allowed partner countries in Vietnam, Lao PDR and Cambodia to have opportunities to interact with each other, and the significance of learning from each other across borders has led to these plans. It is highly anticipated that international exchanges will be developed not only between Japan and the partner countries and among partner countries, but also in the wider region, and that efforts to improve access to justice will expand throughout the Asian region.

(1) Outcomes at the end of the grant period
This project was implemented with the aim of realizing a learning exchange on "Access to Justice" among four countries,Japan and its partner countries; Vietnam, Lao PDR and Cambodia.
The online seminar, in which the four countries participated, made it possible to share the current legal systems, initiatives, issues, etc. in the four countries as a whole. Specifically, the four countries confirmed that they have common issues, such as insufficient access to justice for people in underpopulated areas and lack of resources, such as human and financial resources, to adequately provide justice support.
The bilateral workshops conducted between Japan and partner countries enabled a more in-depth exchange of information on specific systems and approaches in Japan and partner countries on issues of interest to each partner country. To cite a specific example, a session in which a Vietnamese lawyer working in a depopulated area and a Japanese lawyer involved in providing judicial assistance to the poor participated as speakers was a fruitful learning experience for both countries, as they shared real stories from the field.
In addition, as activities between the two countries, seminars were held for university students in Cambodia and for judicial officials in Laos, each with a large number of participants. At these seminars, project members shared project results with participants and received feedback from them. Through these efforts, project members gained a deeper understanding of the project's learning content through dissemination, were exposed to various perspectives and knowledge to further improve "Access to Justice", and gained perspective to consider future policies in their respective countries.
The results of the project activities between the two countries were shared in a four-country online seminar, and future prospects were also confirmed in the four countries as a whole.
In addition, materials on access to justice were translated into local languages and shared with partner countries, which provided new learning materials on "Access to Justice" for members and judicial officials in the partner countries.
(2) Expected Ripple Effects
Through this project, we were able to learn from each other and share information on issues and efforts related to "Access to Justice" in Japan and partner countries, and we will continue to implement activities to realize "Access to Justice" in each country by utilizing what we learned from this project. It is expected that the participants will develop their own initiatives to implement activities to realize "Access to justice" in their respective countries based on what they learned from this project. In doing so, it is expected that the educational materials on access to justice shared in this project will be utilized.
In addition, as mentioned in (1) above, in Lao PDR and Cambodia, sharing and dissemination of the results of this project have already been conducted for seminar participants who are or may be involved in access to justice-related work. Members of partner countries, including project members in Vietnam, have expressed willingness to continue and develop similar efforts.
In addition, the Cambodian project members plan to hold an expanded seminar on improving access to justice in Phnom Penh in January or February 2023, inviting not only members of this project but also judicial officials from Singapore and the Philippines. This project has allowed partner countries in Vietnam, Lao PDR and Cambodia to have opportunities to interact with each other, and the significance of learning from each other across borders has led to these plans. It is highly anticipated that international exchanges will be developed not only between Japan and the partner countries and among partner countries, but also in the wider region, and that efforts to improve access to justice will expand throughout the Asian region.
