On January 20, 2023, the Federal Communication Commission (FCC or
Commission) announced the long-awaited effective date of new
requirements for certain calls that are otherwise exempt from the
Telephone Consumer Protection Act. These new rules stem from a
December 2020 Report and Order, which updated a number of TCPA
exemptions pursuant to the Pallone-Thune Telephone Robocall Abuse
Criminal Enforcement and Deterrence Act (TRACED Act). Among other
things, the Report and Order added call limits and opt-out
requirements for the following types of artificial or prerecorded
voice calls: (1) non-commercial calls to a residence; (2) commercial
calls to a residence that do not include an advertisement or
constitute telemarketing; (3) tax-exempt nonprofit organization calls
to a residence; and (4) HIPAA-related calls to a residence.

Subject: Ebay division TCGPlayer forms union with CWA
A supermajority of workers at TCGPlayer’s authentication center in New
York announced that they are forming the TCG Union/CWA and have filed
for a union representation election with the National Labor Relations
Board. TCGPlayer is the number one online marketplace for collectible
trading cards and was acquired by eBay in November 2022. TCGPlayer
workers are the first group of eBay workers to file for a union
representation election with CWA.

Subject: CFPB Issues Its Own Dark Patterns Guidance For Negative
Option Practices

Drawing from the Federal Trade Commission's recent policy statement
and its own past enforcement actions, the Consumer Financial
Protection Bureau issued a new circular for companies offering
negative option subscription services, that highlights examples of
unlawful behavior by companies that have used dark patterns and other
manipulative tactics to trick consumers into paying recurring charges
for unwanted products and services. The two agencies are partnering in
efforts to combat dark patterns and expressed their commitment to
bringing action where necessary.
