| 内容記述 | 予防原則(precautionary principle)は,1970年代からEUの環境政策の原則として発達した概念であるが,その定義や具体的意味内容について諸説があり,判例も慣習国際法上の原則であるかどうかについては慎重な立場をとっている。1990年代後半以降,EUがこの原則を食品安全分野に援用した結果,WTO,コーデックス委員会等での論議の影響を受けることとなり,欧州委員会「予防原則に関するコミュニケーション」(2000)で表明された予防原則は,科学的リスク分析の枠組みの中に従属的に位置づけられるものとなった。このことは,科学的原則を重視し予防原則の概念に反対する米国の考え方に接近したようにも見えるが,両者の考え方には実質的にはかなりの相違が依然として存在し,この概念をめぐる米欧問の基本的な対立の構造は変わっていない。このような様々な論争や曖昧さを抱えながら,予防原則が,環境分野と食品安全両分野において,政策決定者や裁判所が行う条約または慣習法の解釈および適用に影響を与えるものになっていることは確かである。 ただし,これら両分野における予防原則をめぐる事情はかなり異なり,両分野を区別した議論が必要であろう。 |

| 内容記述 | The precautionary principle emerged and has been developed in European environmental policy sectors. But the concept of the principle hasn't well defined. The question whether the principle has become a rule of customary international law or not is controversial and judicial precedents seem to hesitate to recognize its normative status. EU invoked the precautionary principle to the area of food safety policy in the later 1990s, and consequently EU positions on the principle which are outlined in European Commission Communication (2000) appears to have shifted in favor of a science-based us approach under the influence of WTO, Codex, and OECD. However, the difference of the approach between EU and us has remained and the precautionary principle has certainly become a principle by which decision makers and courts may be affected in the interpretation and application of treaties, Or rules of customary law in the area of the environmental and food safety policy. It also should be noticed that the precautionary principle will be applied in a different way between these two policy sectors. | |||||||||||
